Terms and conditions for using ViViDio Connect. Please read before using the Chrome Extension, Web App, or any related service.
Welcome to ViViDio Connect, a product of ViViD App Studio, operated by ViViD Global Services. By accessing or using the Service (Chrome Extension, Progressive Web Application, or any related service), you agree to comply with and be bound by these Terms of Service. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing and using ViViDio Connect (the "Service"), you accept and agree to be bound by these Terms of Service, our Disclaimer, Privacy Policy, Refund & Cancellation Policy, and Dispute Resolution policy. If you do not agree to any of these terms, you must not use the Service.
2. Description of Service
ViViDio Connect is a B2B messaging automation platform that helps users send personalized messages via WhatsApp and integrate with Google Sheets. The Service is offered as a Chrome Browser Extension and a Progressive Web Application (PWA). We provide tools for automation, template management, campaign tracking, and analytics. The Service is provided "AS IS" as set out in our Disclaimer.
3. No Affiliation with Meta / WhatsApp
ViViDio Connect is not affiliated with, endorsed by, or officially connected with Meta Platforms, Inc., WhatsApp LLC, or any of their affiliates. WhatsApp and related marks are trademarks of their respective owners. We are an independent software provider. Use of the Service may be subject to Meta’s and WhatsApp’s terms and policies; you are solely responsible for your compliance with them. We assume zero liability for any suspension, restriction, or ban of your WhatsApp or other third-party accounts.
4. User Conduct and Prohibited Uses
You are solely responsible for your use of the Service and the content you send. You agree NOT to use the Service to:
- Send illegal spam, unsolicited bulk messages, or commercial communications in violation of applicable law (including anti-spam and telecommunications regulations).
- Harass, abuse, threaten, or send defamatory, obscene, or illegal content.
- Impersonate any person or entity or misrepresent your identity or affiliation.
- Violate WhatsApp’s Terms of Service, Meta’s policies, Google’s terms, or any third-party platform rules.
- Reverse-engineer, decompile, or attempt to derive source code of the Service (except as permitted by law).
- Resell, sublicense, or commercially exploit the Service in a manner not permitted by us.
We may suspend or terminate your access immediately if we reasonably believe you have violated these terms or applicable law.
Important: We are not responsible if your WhatsApp account is banned or restricted due to excessive automation or violation of Meta’s/WhatsApp’s terms. Use the Service responsibly and at your own risk.
5. License and Device Binding
We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms. Your license may be bound to a single device or account as specified at the time of subscription. Device or account transfers may require our approval. Sharing credentials or circumventing device or license restrictions is prohibited.
6. Subscription and Payments
Paid subscription terms are set out in our Subscription & Payment Policy and Refund & Cancellation Policy. Payments are processed via Razorpay (or our designated payment provider). By subscribing, you agree to those policies.
7. Intellectual Property
All content, software, designs, trademarks, and materials provided as part of the Service are the property of ViViD Global Services or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. "ViViDio Connect" and "ViViD App Studio" are our marks.
8. Disclaimer of Warranties and Zero Liability
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the maximum extent permitted by law, we disclaim all liability for any damages arising from your use or inability to use the Service, including but not limited to WhatsApp account bans, data loss, or business interruption. 9. Changes to Terms
We may modify these Terms of Service at any time. We will indicate the last updated date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the revised terms. If you do not agree, you must stop using the Service.
10. Governing Law and Disputes
These Terms are governed by the laws of India. Any dispute is subject to our Dispute Resolution policy (mandatory individual arbitration, waiver of class actions, jurisdiction in Bengaluru, Karnataka, India).
